Higher-Level Review • Same record • No new evidence

Understand Whether Higher-Level Review May Fit Your VA Decision

Start with your VA decision letter. Our Veteran-led team will explain what the record already shows and where medical-evidence work may fit, in plain English. You or your VA-accredited representative choose the review lane and file the VA request; VA decides the review outcome.

Start with the exact issue, decision date, evidence list, and reason VA gave.

Start with the denial date

When did you receive your denial?

Check your deadline first

VA requires an eligible Higher-Level Review request within one year of the date on the initial or Supplemental Claim decision letter.

Official form and decision-review rules

Use the right form for the right record.

The current VA Form 20-0996 is dated March 2024. VA also offers an online Higher-Level Review request for disability compensation claims.

Start With the Decision Letter

The exact issue, decision date, evidence list, and reason for decision determine whether HLR even makes sense.

What Higher-Level Review actually does

A senior reviewer checks the same record. Nothing new enters.

VA describes HLR as a new review of a previously decided issue based on the evidence it had when it issued the prior decision. The reviewer looks for an error or a difference of opinion that changes the result.

The record is closed

The Higher-Level Reviewer will not consider evidence VA received after the notification date of the decision. A new treatment note, lay statement, DBQ, or nexus opinion belongs in a review lane that accepts new evidence.

Ask: was the answer already in the file?

Only listed issues get reviewed

Item 18A asks for each specific issue of disagreement. Item 18B asks for the date on VA's decision notice. Multiple benefit types require separate forms.

Use VA's exact issue name and date.

The conference is not a hearing

You or an appointed representative may request one optional informal conference to identify factual or legal errors. It may delay the decision, and it still cannot introduce new evidence.

Prepare the error and existing record cite.

One important exception: a duty-to-assist error

VA says it may uphold the decision, change it, or find that VA did not help gather evidence it should have gathered before the earlier decision. In that third outcome, VA explains how it will correct the error and may request information or schedule an exam. That is VA correcting its prior evidence-development error; it is not permission to attach new evidence to the HLR request.

What to have in front of you

A useful HLR conversation starts with the paper VA issued and the evidence VA already had. Not a new diagnosis. Not a new statement. The existing record.

1

Decision notice

Use the date on VA's initial or Supplemental Claim decision letter. VA requires an eligible HLR request within one year of that date.

2

Exact issue

Copy VA's issue name, decision outcome, favorable findings, and the reason-for-decision paragraph.

3

Existing record cite

Identify the exam, DBQ section, treatment note, upload date, or evidence-list item that VA may have missed or misread.

4

Right kind of help

TYFYS can organize medical-evidence gaps. A VA-accredited representative should handle representation, legal argument, or the choice between review lanes.

Three different problems

Not every denial belongs in Higher-Level Review

The right next step depends on whether VA missed something already in the record, the claim needs new evidence, or the dispute is procedural or legal.

HLR may fit
Same-record error

The decision says no diagnosis was shown, but the diagnosis and date were already in the evidence VA listed before the decision. The disagreement can be stated using the existing record.

1

Show the existing fact

No new document required

Not an HLR fix
New evidence needed

VA denied nexus, and the record never contained a competent medical opinion connecting the condition to service. A new opinion cannot be added to a Higher-Level Review.

2

Build the missing evidence

Ask about a lane that accepts it

Accredited help
Procedure or legal argument

The dispute turns on continuous pursuit, an effective-date rule, representation at the informal conference, or another legal question. TYFYS does not provide that representation.

3

Use a VA-accredited representative

VSO, claims agent, or attorney

These are educational examples, not legal advice. VA decides eligibility, review outcomes, ratings, and effective dates.

Where TYFYS fits — and where it does not

We prepare defined medical-evidence deliverables. You or your appointed VA-accredited representative select the review lane and file the VA request. We do not represent you before VA or run the informal conference.

1

Separate error from evidence gap

We start with the reason VA gave. If the answer was already in the record, that is different from a denial caused by a missing diagnosis, nexus opinion, severity finding, or treatment record.

2

Build medical evidence for a later lane

If the claim needs a new DBQ, nexus opinion, record review, or documented functional loss, that new material cannot enter the HLR. It may matter in a review option that accepts new evidence.

3

Organize an accredited handoff

We can help you put the decision, evidence list, and medical-record questions in order before you speak with a VA-accredited VSO, claims agent, or attorney about procedure or representation.

When we stop

If the disagreement is purely a legal or procedural same-record issue and there is no medical-evidence work for us to do, we will say that. Use a VA-accredited representative for representation and legal advice. The free VA representative search is linked above.

Already received the HLR decision?

What if your Higher-Level Review was denied or upheld?

VA says you cannot request another Higher-Level Review after a previous Higher-Level Review or Board Appeal on the same issue. After an HLR decision, VA identifies a Board Appeal or a Supplemental Claim with new and relevant evidence as possible next options. A VA-accredited representative can help you evaluate the procedural choice; TYFYS can review whether the medical record still has an evidence gap.

It is VA Form 20-0996 — not 21-0996

The official title is Decision Review Request: Higher-Level Review. The current VA Form 20-0996 is a fillable, printable PDF dated March 2024. VA also accepts online HLR requests for disability compensation claims.

Searches for VA Form 21-0996, 0996 VA form, or higher level review form usually mean the same official 20-0996 request. Download it only from VA.gov so you have the current edition and instructions.

TYFYS means Thank You For Your Service. We are a private, veteran-led medical evidence team. We prepare defined medical-evidence deliverables. You or your appointed VA-accredited representative select the review lane and file the VA request. We do not represent Veterans before VA, conduct informal conferences, or give legal advice.

TYFYS is not the VA, not a VSO, not a law firm, and is not affiliated with the U.S. Department of Veterans Affairs.

Start with one honest question.

Did VA miss or misread something already in the file, or does the claim need new medical evidence that an HLR cannot accept? We will help you separate those two problems before discussing any paid work.

Private intake. This form does not itself file a claim. TYFYS is not the VA, not a VSO, and not a law firm.
